TERMS OF USE & ACCESSIBILITY POLICY

These Terms of Use (“Terms”) govern your access to and use of www.mielcasa.com (the “Site”) and the products, services, features, communications, and other services offered by Catch Group LLC DBA Mielcasa (“Mielcasa,” “we,” “our,” or “us”).

IMPORTANT NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER THAT MAY AFFECT YOUR LEGAL RIGHTS. PLEASE REVIEW THE ARBITRATION AND CLASS ACTION WAIVER SECTIONS CAREFULLY.

1. ACCEPTANCE OF TERMS

Your access to and use of the Site, its content, tools, accounts, products, shopping features, communications, and other services (collectively, the “Services”) are subject to these Terms and our Privacy Policy.

By accessing, browsing, purchasing from, or otherwise using the Services, you acknowledge that you have read and agree to these Terms and our Privacy Policy.

If you do not agree, please do not use the Services.

2. CHANGES TO THESE TERMS

We may modify these Terms from time to time. The current version will be posted on the Site with its applicable Effective Date.

If we make material changes affecting your rights or obligations, we may provide notice through the Site, email, or another reasonable method.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

3. MIELCASA CUSTOMER ACCOUNTS

Certain Site features may require you to create an account.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.

You agree to provide accurate and current information and promptly update information that changes.

You may not impersonate another person, create an account using false information, or access another person's account without authorization.

We may access, preserve, or disclose account information as described in our Privacy Policy, as required by law, or when reasonably necessary to protect Mielcasa, our customers, or others.

4. AGE REQUIREMENTS

The Services are intended for adults capable of entering into legally binding transactions.

If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and permission of a parent or legal guardian.

We do not knowingly collect personal information directly from children under 13 without appropriate parental or guardian authorization.

5. ORDERS, PAYMENT & BILLING

Order Acceptance

Submitting an order does not necessarily constitute final acceptance of the order by Mielcasa.

All billing, shipping, and customer information provided must be truthful and accurate.

We reserve the right to verify information before accepting or fulfilling an order and may request identification, payment verification, delivery verification, or other information reasonably necessary to prevent fraud and protect the transaction.

We reserve the right to refuse, limit, or cancel an order for legitimate reasons, including:

Product availability
Pricing or listing errors
Incorrect product information
Payment authorization problems
Suspected fraud or unauthorized transactions
Shipping or delivery limitations
Manufacturer or supplier availability
Quantity limitations

If we cancel an order after payment has been captured, we will issue any refund due in accordance with applicable law and our policies.

Payment Authorization

When you place an order, Mielcasa or its payment processor may authorize your payment method.

An authorization may temporarily reduce the available balance or credit on your account even though the transaction has not yet been fully captured.

Where applicable, payment may be captured after verification of customer information, product availability, delivery arrangements, shipment, pickup, or other applicable order-processing requirements.

By confirming your purchase, you authorize Mielcasa and its payment providers to process amounts properly due under your order.

Pricing

We attempt to provide accurate pricing, but errors may occur.

If an item is listed at an incorrect price because of a typographical, technical, supplier, manufacturer, or other error, we reserve the right to correct the error and cancel the affected order to the extent permitted by law.

Prices, promotions, availability, shipping charges, and discounts may change without notice before an order is finalized.

6. PRODUCT INFORMATION & AVAILABILITY

Mielcasa works to provide accurate product descriptions, specifications, dimensions, photographs, colors, pricing, and availability.

However, furniture manufacturers and suppliers may modify products, materials, finishes, dimensions, packaging, specifications, or availability without advance notice.

Colors displayed on screens may also vary from actual products because of lighting, photography, screen calibration, manufacturing variations, natural materials, and other factors.

Measurements and dimensions may be approximate.

Product availability is not guaranteed until an order has been confirmed and processed.

7. SHIPPING, DELIVERY & RISK OF LOSS

Shipping and delivery estimates are estimates rather than guarantees unless expressly stated otherwise in writing.

Delays may occur because of manufacturers, suppliers, freight carriers, weather, transportation conditions, inventory availability, customer availability, incorrect delivery information, or circumstances outside Mielcasa's reasonable control.

Customers are responsible for providing accurate delivery information and ensuring reasonable access for delivery.

Additional fees may apply for services or conditions such as redelivery, storage, address changes, difficult access, stairs, special handling, or upgraded delivery services when disclosed and permitted by applicable law.

Risk of loss and title will transfer as provided by applicable law and the applicable shipment or delivery arrangement.

8. RETURNS, CANCELLATIONS & REFUNDS

Returns, cancellations, exchanges, damaged merchandise claims, and refunds are governed by the Mielcasa Return & Exchange Policy applicable to your purchase.

Customers should review the Return & Exchange Policy before purchasing.

Products must satisfy the conditions stated in the applicable policy to qualify for return or exchange.

Mielcasa reserves the right, to the extent permitted by law, to reject fraudulent, abusive, excessive, unauthorized, or policy-noncompliant return requests.

Nothing in these Terms limits any non-waivable consumer rights provided by applicable law.

9. INFORMATION PROVIDED ON THE SITE

Information provided through the Site is intended to assist customers in evaluating and purchasing products.

Although we attempt to maintain accurate information, we do not guarantee that every description, photograph, dimension, specification, price, availability statement, or other piece of information will always be complete, current, or error-free.

Customers should contact Mielcasa before purchasing if a particular specification, dimension, finish, feature, delivery requirement, or other characteristic is essential to their purchasing decision.

10. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Site and its content—including text, graphics, photographs, product presentations, logos, icons, designs, software, interfaces, videos, and other materials—are owned by or licensed to Mielcasa and may be protected by copyright, trademark, and other intellectual-property laws.

Your use of the Site does not transfer ownership of any intellectual property to you.

Subject to these Terms, Mielcasa grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for lawful personal shopping and informational purposes.

Without prior written permission, you may not reproduce, republish, commercially exploit, systematically download, scrape, distribute, modify, reverse engineer, or create derivative works from protected Site content except where applicable law expressly permits such activity.

Third-party product names, manufacturer names, logos, trademarks, photographs, and other materials remain the property of their respective owners.

11. ACCEPTABLE USE

You agree not to use the Site to:

Violate applicable laws or regulations
Commit fraud or impersonate another person
Access another customer's account without authorization
Introduce viruses, malware, malicious code, or harmful technologies
Attempt to compromise Site security
Interfere with the Site's operation or other customers' use

Infringe copyrights, trademarks, privacy rights, or other legal rights
Use the Site for unlawful, abusive, threatening, defamatory, or fraudulent purposes

We may restrict or terminate access when we reasonably believe these Terms have been violated.

12. USER CONTENT & REVIEWS

By submitting User Content, you represent that you have the necessary rights to provide it and that it does not violate applicable law or the rights of another person.

To the extent permitted by law, you grant Mielcasa a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, adapt, and use User Content in connection with our business, Site, products, marketing, and Services.

We may moderate or remove User Content that violates these Terms or applicable law.

14. ELECTRONIC COMMUNICATIONS

When you use the Services or communicate electronically with Mielcasa, you consent to receive transactional communications electronically, including emails, text messages, order notifications, and Site notices, as permitted by applicable law.

Marketing text messages or marketing emails will be handled according to applicable consent and opt-out requirements.

Electronic communications may satisfy legal requirements that communications be provided in writing to the extent permitted by applicable law.

15. THIRD-PARTY SERVICES & LINKS

The Site may contain links to or integrations with third-party websites, payment processors, financing companies, delivery providers, social networks, analytics providers, or other services.

Third-party services operate under their own terms and privacy practices.

Mielcasa is not responsible for independent third-party websites, content, policies, products, or services except to the extent responsibility cannot legally be excluded.

16. TERMINATION

You may stop using the Services at any time.

Mielcasa may suspend, restrict, or terminate access to the Site or an account if we reasonably determine that a customer has violated these Terms, engaged in fraudulent activity, created a security risk, abused our Services, or where suspension is otherwise permitted by law.

17. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

MIELCASA DISCLAIMS WARRANTIES THAT MAY LEGALLY BE DISCLAIMED, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, COMPLETELY ACCURATE, OR FREE FROM ERRORS OR HARMFUL COMPONENTS.

THIS DISCLAIMER DOES NOT EXCLUDE OR LIMIT WARRANTIES, CONSUMER PROTECTIONS, OR OTHER RIGHTS THAT CANNOT LAWFULLY BE WAIVED.

Manufacturer warranties, when applicable, are governed by their respective terms.

18. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MIELCASA, CATCH GROUP LLC, AND THEIR OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

THIS LIMITATION APPLIES ONLY TO THE EXTENT PERMITTED BY LAW.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

19. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Catch Group LLC DBA Mielcasa and its officers, employees, agents, contractors, and affiliates from claims, liabilities, damages, costs, and reasonable attorneys' fees arising from your unlawful use or misuse of the Services, violation of these Terms, infringement of another person's rights, or User Content you submit.

20. DISPUTE RESOLUTION & BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT MAY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE CERTAIN DISPUTES DECIDED IN COURT BY A JUDGE OR JURY.

Informal Dispute Resolution

Before initiating arbitration, you and Mielcasa agree to make a good-faith effort to resolve the dispute informally.

A written notice should describe the dispute, the requested resolution, and appropriate contact information.

The parties agree to attempt in good faith to resolve the dispute before initiating arbitration.

Binding Arbitration

Except for disputes that applicable law permits or requires to be resolved elsewhere, disputes that cannot be resolved informally may be resolved through binding individual arbitration pursuant to applicable law and the applicable rules of the arbitration administrator.

The Federal Arbitration Act will govern the interpretation and enforcement of this arbitration agreement where applicable.

Arbitration is generally less formal than court litigation and uses a neutral arbitrator instead of a judge or jury.

BY AGREEING TO ARBITRATION, THE PARTIES MAY WAIVE THE RIGHT TO A JURY TRIAL FOR CLAIMS SUBJECT TO ARBITRATION.

Nothing in this section prevents either party from pursuing an eligible individual claim in small claims court where jurisdiction and venue requirements are satisfied.

Arbitration Opt-Out

You may opt out of this arbitration agreement by providing written notice to Mielcasa within 30 days of your first acceptance of these Terms.

Your notice must clearly state your name, contact information, and your intention to opt out of arbitration.

If you properly opt out, neither you nor Mielcasa will be bound by this arbitration provision with respect to your relationship under these Terms.

21. CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MIELCASA AGREE THAT DISPUTES SUBJECT TO ARBITRATION WILL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim, except where applicable law requires otherwise.

If a court of competent jurisdiction determines that a particular portion of this class-action waiver cannot lawfully be enforced, that determination will be handled according to applicable law without unnecessarily invalidating the remainder of these Terms.

22. GOVERNING LAW

These Terms and your relationship with Mielcasa will be governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

For disputes properly brought in court and not subject to arbitration, the parties consent to jurisdiction and venue in an appropriate state or federal court located in Orange County, California, except where applicable law requires another jurisdiction or venue.

23. COPYRIGHT & DMCA

If you believe material appearing on Mielcasa's Site infringes a copyright you own or are authorized to represent, you may submit a written copyright infringement notice containing the information required under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.

A knowingly false or materially misleading infringement notice may result in liability under applicable law.

24. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect, subject to any specific requirements contained in the arbitration and class-action provisions.

25. NO WAIVER

Our failure to enforce a provision of these Terms does not constitute a permanent waiver of that provision or our right to enforce it later.

26. ENTIRE AGREEMENT

These Terms, together with our Privacy & Cookie Policy, Return & Exchange Policy, Shipping & Delivery Policy, and any additional terms applicable to a particular transaction or promotion, constitute the applicable agreement between you and Mielcasa concerning your use of the Services.

27. ACCESSIBILITY POLICY

Mielcasa is committed to providing an accessible online shopping experience to customers, including individuals with disabilities.
